Family Medical LeaveThe federal government has passed a law that provides for up to 12 weeks of unpaid family medical leave. This law is called the Family Medical Leave Act, and it applies to all kinds of private employers and certain government employers. The Family Medical Leave Act does not apply to all employees or all employers, however. In order to receive family medical leave from your employer and be protected under the statute, you and your employer must meet certain requirements, including:
If all these requirements are met, you are protected under the FMLA. You are entitled to take leave from your employer for serious medical conditions, pregnancy or temporary disability and come back from the leave to the same or similar position. At Haskin Lauter & LaRue, we represent employees in Indiana who have been denied medical leave, employees who have been fired for taking medical leave, or who were allowed to take medical leave but, when they try to come back to work, were not reinstated. If your employer retaliates against you for taking medical leave, you are protected. Call the experienced medical leave attorneys of Haskin Lauter & LaRue today for a free telephone consultation.
